Legal Action Moves Forward Against Top Whatcom County Officials

Bellingham, WA- Community leader, Rosalinda Guillen, filed a lawsuit for over $230,000,000 on October 10, 2017 in Whatcom County Superior Court against Defendants, Sherriff Bill Elfo, County Prosecutor David McEachran, and County Executive Jack Louws, based on their unlawful actions in the 2015 election year. The lawsuit alleges that Louws, Elfo, and McEachran violated Revised Code of Washington (RCW) 42.17A by using county resources for their reelections and publishing a biased and deceptive mailer to registered voters. A joint campaign flyer paid for by the campaigns for four self-described “nonpartisan” candidates running for office in Whatcom County in the November general election, just arrived in voters’ mailboxes. The top of one side of the flyer reads: “Tired of Partisan politics? So are we.” The flip side of the flyer reads, in part: “We Don’t Want To Be Elected By A Political Party, We Want To Be Elected By The People.”

It is infuriating that small city Mayors Mutchler and Korthuis are using mental health services and diversion programs to sell the jail sales tax to voters in this op-ed in the Bellingham Herald, when they were supporting the Jail Facility Finance and Use Agreement with no assurances of monies for these. Robbins is running against Port candidate Michael Shepard, whose background garnered him an endorsement by the Washington Conservation Voters, which supports environmentally responsible candidates who their organization expects to be environmental champions that will protect and restore Washington’s environment. I wrote to all of you last week regarding creating ordinances that would provide more protections for members of our undocumented immigrant community. I recently had a local government official share their perspective on that letter with me.
